Hungarian trademark registration
In Hungary trademarks enjoy protection for 10 years from the date of application. This term can be extended with further 10-year periods by renewal. Not only national trademarks are valid in Hungary but also EU-Community Trademarks (CTM) and international trademarks (IR) filed according to the Madrid Agreement or Protocol.The Hungarian trademark registration follows the opposition system since it has joined the EU in 2004. This means that the Hungarian Intellectual Property Office (former Patent Office) completes a search for previous rights, but only upon the opposition filed by the proprietors of these rights can registration be refused. Effective use of trademark needs to be proven by right holder, if the mark has been registered for more than 5 years, otherwise the protection may be revoked. The substantive examination of the Office includes ex officio only the so-called absolute grounds of refusal.
